In projects requested by private landowners and approved by the City, the City at its expense shall provide all labor and equipment, and the total cost of removal of existing curb & gutter or sidewalk sections, backfilling, and similar removal costs. The landowner shall pay the cost of materials for the curb and gutter or sidewalk; a per-foot charge for saw cuts, and the out-of-pocket administrative costs of the city, such as legal publications. Applicable engineering plans and specifications shall be provided by the city and shall be paid for one-half by the city and one-half by the landowner.

The landowner agrees to pay the City one-half of the estimated landowners share of costs and charges before the work is undertaken. The landowner agrees to pay the remainder of the landowner's share of costs and charges within 30 days after the work is completed. The landowner understands that the actual costs and charges may be more or less than the estimated costs and charges.

-Excavating City Streets and/or Alleys

The following precautions will be taken to protect the public:
  1. An appropriate number of wooden or other suitable barricades will be placed at the excavation site. The barricades will be positioned to inform the public of the road construction ahead. 
  2. Sufficient lighting will be placed along the excavation site from dusk until dawn to warn the public of the potential road hazards.
  3. During the excavation process, the applicant will use all reasonable and proper precautions to avoid damage or injury to people and property. 
  4. The City of Concordia will be held harmless from any and all injuries, expenses or damages caused by willful acts or negligence caused on behalf of the applicant or any of the applicant's agents, servants, officers or employees. 

The applicant will assume responsibility for maintenance at the site of excavation for a period of 18 months. At the expense of the applicant, the paving or any other surface disturbed during excavation will be returned to the condition prior to excavation in a manner satisfactory to the Public Works Director.
